TERMS & CONDITIONS PowerLiftMoving LLC Effective Date: 2/22/26 These Terms and Conditions (“Terms”) govern all services provided by PowerLiftMoving LLC (“Company,” “we,” “us,” or “our”). By booking, scheduling, or using our services, you (“Client” or “Customer”) agree to be legally bound by these Terms. 1. COMPANY STATUS & SERVICE AREA PowerLiftMoving LLC is a limited liability company operating within the State of Florida. The Company maintains general liability insurance. The Company is not a common carrier unless explicitly agreed to in writing. Primary Service Radius The Company operates primarily within a five (5) mile radius of Tampa, Florida. Services requested outside of this five (5) mile primary service radius are subject to additional travel fees. Any applicable travel charges will be disclosed prior to booking confirmation. Move Classification For operational and billing purposes: Local Moves are defined as moves where the distance between load and unload locations is fifty (50) miles or less. Long-Distance Moves are defined as moves exceeding fifty (50) miles between load and unload locations and are subject to additional travel charges. 2. SERVICES PROVIDED The Company provides professional moving labor services, including: Loading and unloading of trucks, trailers, containers, and storage units In-home moves and furniture rearranging Basic disassembly and reassembly of standard furniture Protective wrapping and padding Strategic packing of trucks or containers Handling of heavy or oversized items when disclosed in advance Optional third-party truck rental coordination Optional junk removal add-on services All services are subject to availability, safety conditions, and accurate disclosure of job details. 3. LABOR-ONLY SERVICE TERMS When the Client provides the truck, trailer, POD, or container: The Company is responsible only for damage directly caused by its crew during active handling (lifting, carrying, loading, unloading). The Company is not responsible for damage occurring during transit. The driver of the vehicle assumes full responsibility for transportation-related damage, shifting, load movement, accidents, or roadway incidents. The Company is not liable for mechanical failures or operational issues involving customer-provided vehicles. 4. COMPANY-HANDLED TRUCK RENTAL SERVICE If the Company coordinates and operates a third-party rental truck: The Company assumes responsibility for handling from load through unload. The Client remains financially responsible for: Rental base rate Mileage charges Fuel Tolls Parking fees Additional charges imposed by rental provider Rental base rates and handling fees are due at booking. Rental base fees are non-refundable once reserved. If a mechanical breakdown occurs: Labor billing pauses during confirmed breakdown delays. The Company is not responsible for rental company errors, equipment defects, or third-party delays. 5. BILLING & PAYMENT TERMS 5.1 Minimum Service Requirement All services require a two (2) hour minimum labor charge. 5.2 Billing Start & Stop Labor billing begins when the crew arrives on-site. Labor billing ends when services are fully completed. If the Company operates a rental truck, mileage and fuel charges begin when the truck departs Company location and end when returned. 5.3 Travel Policy Within fifty (50) miles between load and unload locations: No additional long-distance fee applies. Drive time is included in billable hours. Beyond fifty (50) miles: Additional travel fees apply and will be disclosed before service. 5.4 Same-Day Booking Same-day bookings are subject to an additional $30 per labor hour. 5.5 Payment Terms Deposit required at booking. Remaining balance due immediately upon job completion. Payment accepted via electronic invoice or on-site card processing. Failure to pay may result in collections action, legal action, and recovery of attorney’s fees and associated costs. Non-payment voids any future service obligations. 6. CANCELLATION & REFUND POLICY Deposit refunds are as follows: 72+ hours before scheduled service: 100% refund (excluding reserved truck rental base fees) 48–72 hours: 75% refund 24–48 hours: 50% refund Less than 24 hours: 25% refund or non-refundable Truck rental base fees are non-refundable once reserved. 7. ADDITIONAL FEES Additional charges may apply for: Overweight or specialty items Long carries Excessive stairs involving heavy items Undisclosed items Unsafe or extreme job conditions Service locations outside primary 5-mile Tampa radius All additional fees will be communicated prior to or during service when possible. 8. JUNK REMOVAL ADD-ON Junk removal is billed by volume used in truck bed space and subject to a minimum charge. The Company will not remove: Flammable or hazardous materials Chemicals or solvents Propane tanks Ammunition Biohazard waste Automotive fluids Tires Restricted or illegal disposal materials If prohibited materials are mixed with junk items, the Company may refuse removal. The Client assumes liability for contamination, damage, or disposal violations caused by undisclosed hazardous materials. Disposal location (landfill, transfer station, or donation center) is at Company discretion. 9. LIABILITY LIMITATIONS 9.1 Claims Deadline All damage claims must be submitted in writing within forty-eight (48) hours of service completion. Failure to submit within this timeframe constitutes waiver of claim. 9.2 Limitation of Liability Company liability is limited to repair cost or fair depreciated value, whichever is less. The Company is not liable for sentimental, replacement, or consequential damages. 9.3 Exclusions The Company is not liable for: Items packed or pre-wrapped by Client Contents of boxes Pressboard, particleboard, or ready-to-assemble furniture Pre-existing damage Mechanical failure of furniture Structural weaknesses Weather-related exposure Minor scuffs to walls, floors, railings, or door frames Tight staircases or narrow hallways Undisclosed fragile or specialty items 10. PRE-EXISTING DAMAGE The Client acknowledges that used furniture and structures may contain hidden structural weaknesses, loose joints, or prior wear. The Company is not responsible for failure due to prior condition. 11. WEATHER CONDITIONS The Company is not liable for damage caused by rain, wind, heat, or environmental exposure unless directly caused by gross negligence. 12. PHOTO DOCUMENTATION The Company reserves the right to photograph items and property before, during, and after service for documentation and claim verification purposes. 13. REFUSAL OF SERVICE The Company reserves the right to refuse or terminate service if: Conditions are unsafe Client exhibits aggressive or threatening behavior Animals are unsecured Hoarding conditions exist Structural hazards are present Severe weather creates unsafe conditions Payment terms are not met 14. INDEMNIFICATION The Client agrees to indemnify and hold harmless PowerLiftMoving LLC from any claims, damages, losses, or liabilities arising from: Client negligence Undisclosed hazardous materials Structural failures Third-party conduct 15. CHARGEBACK POLICY Clients agree not to initiate payment chargebacks without first submitting a written dispute. Fraudulent or bad-faith chargebacks will be contested and may result in legal action and recovery of all associated costs. 16. NON-SOLICITATION Clients agree not to directly hire or solicit Company employees for twelve (12) months following service. Violation may result in a $5,000 liquidated damages fee. 17. FORCE MAJEURE The Company is not liable for delays caused by acts of God, natural disasters, traffic incidents, governmental restrictions, or events beyond reasonable control. 18. SEVERABILITY If any provision of these Terms is deemed unenforceable, remaining provisions remain valid and enforceable. 19. DISPUTE RESOLUTION Any dispute arising from services shall be resolved through binding arbitration within the State of Florida. Client waives the right to trial by jury. 20. ENTIRE AGREEMENT These Terms constitute the entire agreement governing services provided by PowerLiftMoving LLC and supersede any prior verbal statements or representations.
